Plainview Planning are pleased to announce that we have secured planning permission at appeal for 28 homes. The proposal includes 30% affordable housing, plus Section 106 contributions to primary and secondary education facilities, and funding towards the Thanet Coast SPA Mitigation Strategy.
How we did it – strategic planning for a residential development on a complex site
This was a complicated application that was on formally designated open space land. We managed to overcome this issue at an earlier appeal, but the appeal was then dismissed on highway safety grounds. This was challenged at the High Court (Suregold Ltd vs SoS and Dover District Council), and we were successful. The court held that there had been a procedural error as the Inspector had not seen the appellant’s Final Comments, and that the Inspector had failed to apply Paragraph 14 of the National Planning Policy Framework (NPPF 2012 Framework) correctly. A new application was then refused by Dover District Council, necessitating a further planning appeal. The Council continued to argue that the development would result in the loss of public open space. The Inspector held that whilst there would be a reduction in the quantity of informal open space, the proposal was improving the quality of open space in the area with the provision of a children’s play area and formal footpaths to improve accessibility. The Inspector allowed the appeal and approved planning for the development.
We are so glad that we were successful in evidencing the many positives of this proposed development and that as a result of the Inspector’s decision to approve, planning permission has been secured for this exciting scheme. These new homes are in a sustainable location and will assist Dover District Council in achieving their 5-year housing land supply.
