Retrospective application to secure changes to a listed building in the Royal Borough of Kensington and Chelsea

Making our homes and places of work more sustainable and energy efficient is understandably high up on the agenda at the moment.  However, in the case of listed buildings,  the planning system can add an extra layer of complication, through restrictions imposed on the types of alterations allowed on such significant buildings.

This was the case with a recent successful retrospective application we submitted, in order to regularise the planning status of a series of internal renovations and external changes to a Grade II listed building in the Royal Borough of Kensington and Chelsea.  Our client had made these changes, not only to improve the layout of their home but also to improve its energy efficiency.  

Making changes to a listed building

However, changes to a listed building which involve alterations, extensions or demolition and will affect its character, require Listed Building Consent. This can also apply to the setting of a listed building – in essence if you are intending to make changes to any part of a house or grounds covered by the listing, and if its character or unique interest might be affected, then seek professional guidance first.

In regards to this project, the changes made were very sympathetic to the original building and following a careful review and engagement with a Heritage Consultant we prepared an application to seek retrospective permission and Listed Building Consent.  

With listed buildings, the emphasis is often on repair rather than replace, unless of course the damage is so substantial that it is beyond ‘economic repair’. But how do you go about proving this? Things like a structural survey,  quotes from builders/surveyors, before and after photos etc. can help to demonstrate this. It is worth remembering that the onus is on the applicant to demonstrate that repair or maintenance is not possible.  

We are very pleased that we were able to support our client in regularising the planning breaches on their Grade II listed home, and furthermore must thank RBKC for their pragmatism and forward thinking. Indeed, they have recently introduced a  new  planning order (Listed Building Consent Order For Window Works Grade II Listed Buildings in the Royal Borough of Kensington and Chelsea) regarding the installation of secondary glazing and double-glazing in a named number of Grade II  listed buildings within the borough. But be warned; caveats will still apply!

We would always urge you to seek prior permission before making any changes to a listed building as enforcement and fines can be very costly as well as damage and removal of historical features often being irreversible and detrimental to our built heritage. Removing internal walls/changes to plasterwork, staircases, doors and windows are all heavily protected in listed buildings, if unsure, always seek professional advice.
