We have had a couple of clients recently who have ignored enforcement notices for varying reasons. One claims the notice was never received and the other considered the notice to be invalid so didn’t appeal.
We are currently negotiating with the respective Local Planning Authorities to try and avoid prosecution, and it looks like we will be given a chance to rectify both cases via fresh applications. However, throughout the process we were on the back foot.
The problem is that once you miss the deadline for the enforcement appeal or judicial review you are left with no further right of appeal.
Ludicrously, this is the case even if the development is genuinely lawful. Regardless of your situation, if you don’t challenge the enforcement notice then you risk prosecution.
