Negotiation and a comprehensive planning response has enabled the discharge of several complex pre-commencement conditions on a site for 14 new homes in Bradford.
The site:
We were approached by a developer who had purchased the site with an existing consent for 14 houses. However this original approval came with challenging and extensive pre-commencement conditions which needed to be discharged before building could commence. Our client was on a tight build timetable which had to be adhered to.
The scheme was also being strongly resisted by the local neighbours and any proposed works would be carefully scrutinised.
Planning conditions:
For the most part planning conditions exist to enhance the quality of the development and their impact is wide-ranging, from materials and landscaping through to construction hours.
In the case of the 14 dwellings, our work included input on a Traffic Regulation Order; s278 issues; watercourse issues; and material samples. As these were pre-commencement conditions, all the relevant information had to be collated and presented to the council for sign off before building could commence.
How we helped:
We positively engaged with the planning officer and highway officer, encouraging discussion to reach pragmatic outcomes and responded effectively to any concerns raised by the case officer or neighbouring residents. We stressed the importance of adhering to the build timetable and maintained regular contact with the case officer to ensure any additional requests for info were promptly dealt with.
After extensive engagement, we were delighted to receive approval from the case-officer that all the requirements of the pre-commencement conditions had been met, were discharged and our client can now crack on with the build.
