We recently assisted a client with a retrospective application for a project in Uttlesford, Essex. We had previously secured planning permission for them on site for a number of developments, including an artist’s studio. However, during the build process, alterations had been made which meant that the final built form was different to the approved plans. In such instances, planning permission should normally be sought to ensure that the finished building has the appropriate planning permission. In this case the client had been in correspondence with an enforcement officer from the Council and subsequently contacted us to establish how they could proceed to ensure the new home and outbuildings they had almost completed, could be regularised and retained rather than potentially lost through enforcement action.
Following proactive discussions with the enforcement team we established a planning strategy that suited all parties. We worked extensively with the client and their build team to fully ascertain the scope of works, extent of the changes and carefully documented these to ensure that a concise yet explanatory planning statement justifying the changes in policy terms could be drafted and relevant updated plans drawn up.
We also sought an extension of time so that we could conduct a thorough review of the changes and seek quotes for additional third party reports to support the application. Once the application was submitted, we continued our liaison with both the case officer and the enforcement team, ensuring clear communication across the project team. We were very pleased with the positive outcome for our clients and they were understandably thrilled and relieved too.
