Retrospective planning approval for residential annexe in East Hampshire

The Plainview Team recently secured planning permission for a stylish annexe accommodation in the garden of a beautiful family home in East Hampshire, not once but twice!  The project raised an interesting point, what are the key considerations when you want to change something on your planning approval? 

Project background

We first secured planning permission for the annexe back in 2020, to enable our client to live on site and care for their parents. However, as the project was about to be built out, it became clear that for various engineering reasons, the location of the annexe would need to be altered slightly. Given the minor nature of the change, our client thought it would be fine to go ahead with the build in its revised location, not realising that in doing so they had contravened the original planning permission.  As a result, a retrospective application would need to be submitted in order to regularise the planning position on site. 

You need to change your planning permission, what are your next steps?

It happens more often than you might think, as there can be a world of difference between the design concept on paper and the practicalities of building your project out.  If you do find yourself in the position of needing to make changes to your project after receiving planning permission, then what are your options? 

First you need to ascertain if what you are proposing is a . If your proposed changes are considered substantial, then you will need to submit a new planning application.  However, for non-material amendments or for changes to the conditions attached to the planning permission you will need a S96A or a  .  Our team of planning consultants can advise you on whether what you propose is likely to be considered material or non-material, and then provide you with a considered planning strategy for the most appropriate application route. 

In this instance, as the annexe had already been built out, we submitted and secured retrospective planning for the annexe in its revised location.
