Planiview Planning have secured a Certificate of Lawfulness of Existing Use relating to 6 flats in the London Borough of Brent.
We helped the applicant put together a timetable of events and supported this with a legal commentary. There were some small gaps in the evidence, but we put forward convincing arguments that suggested, on the balance of probability, the Certificate should be issued.
The London Borough of Brent had initially threatened enforcement action against our client. We negotiated and agreed that a Certificate of Lawfulness was a more expedient route to regularise the situation. We also put forward a case that only 4 years of evidence was required rather than the 10 years requested by the Council.
The Certificate was issued on time and on budget.
