Plainview Planning have successfully secured a Certificate of Lawfulness of Existing Use for a former agricultural dwelling. The Certificate establishes that the property can now be lived in by anyone, not just those connected with the farm.
We assisted the applicant in collating the necessary evidence and then provided a legal commentary to further support the application. In the case of F W Gabbitas v SSE and Newham LBC it was held that if the Council have no evidence of their own, or from others, to contradict or otherwise make the applicant’s version of events less than probable, there is no good reason to refuse the application.
The Council did not have any contradictory evidence, and the presentation of evidence was clear and unambiguous. Therefore the Certificate was granted.
